Overview

Welcome to Nexkart! The terms "we", "us", and "our" refer to Nexkart. By visiting, browsing, or purchasing from www.nexkart.online, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our Services.

Nexkart operates as a dropshipping business, sourcing and fulfilling products through CJ Dropshipping (China) for delivery to customers in India. Our store is powered by Shopify.

Section 1 – Access & Account

By using our Services, you confirm that you are at least 18 years of age or are accessing the site under the supervision of a parent or guardian. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may not transfer or assign your account to any other person.

Section 2 – Our Products

Nexkart sources products from third-party suppliers via CJ Dropshipping. We make every effort to accurately represent products, but please note:

  • Colours and appearance may vary slightly due to screen settings and manufacturing tolerances.
  • Size measurements may have a tolerance of ±2 cm due to manual measurement.
  • Product descriptions are subject to change without notice.
  • We reserve the right to discontinue any product at any time.

Section 3 – Orders

When you place an order, you are making an offer to purchase. Nexkart reserves the right to accept or decline any order at its discretion. Your order is confirmed only after payment is successfully processed and you receive an order confirmation email.

  • Orders can be cancelled within 12 hours of placement, provided they have not been forwarded to CJ Dropshipping for processing.
  • Once dispatched, orders cannot be cancelled. Please refer to our Refund & Returns Policy.
  • Purchases are for personal or household use only and not for commercial resale or export.

Section 4 – Prices & Billing

  • All prices are listed in Indian Rupees (INR) and include applicable GST where stated.
  • Prices, discounts, and promotions are subject to change without notice.
  • The price charged will be the price in effect at the time the order is placed, as shown in your order confirmation.
  • You represent that your payment information is accurate and that you are authorised to use the payment method provided.

Section 5 – Payments

All payments are processed securely through Razorpay, our payment gateway partner in India. We accept:

  • Credit/Debit Cards (Visa, Mastercard, RuPay)
  • UPI (Google Pay, PhonePe, Paytm, etc.)
  • Net Banking
  • Wallets
  • Cash on Delivery (COD) — available for select pin codes

Nexkart does not store your card or UPI details. All payment data is handled by Razorpay in compliance with PCI-DSS standards.

Section 6 – Shipping, Delivery & Dropshipping Disclosure

Nexkart fulfills orders through CJ Dropshipping, a fulfillment partner based in China. By placing an order, you acknowledge that:

  • Your order will be shipped directly from China to your address in India.
  • Estimated delivery time is 7–20 business days after dispatch.
  • Your personal data (name, address, phone number) will be shared with CJ Dropshipping and their logistics partners to fulfill your order.
  • Orders may be subject to Indian customs duties and IGST as per Indian import regulations, which are the customer's responsibility.
  • Nexkart is not liable for delays caused by customs clearance, carrier issues, or events outside our control.

Section 7 – Privacy Policy & Data Protection

All personal information collected through our Services is governed by our Privacy Policy, which complies with the Digital Personal Data Protection Act, 2023 (DPDPA) of India. By using our Services, you consent to the collection, use, and cross-border transfer of your data as described in our Privacy Policy, including transfer to CJ Dropshipping in China for order fulfillment.

Section 8 – Refunds & Returns

Your purchases are subject to our Refund & Returns Policy. We accept return or refund requests for damaged, defective, or wrong items within 7 days of delivery. Change-of-mind returns are not accepted due to the nature of cross-border dropshipping.

Section 9 – Third-Party Services

Our Services involve the following third-party partners:

  • Shopify Inc. — e-commerce platform (Canada/USA)
  • CJ Dropshipping — product sourcing and fulfillment (China)
  • Razorpay — payment processing (India)
  • Shiprocket — domestic logistics (India, where applicable)

We are not responsible for the acts or omissions of these third parties beyond our contractual obligations with them. The Services may also contain links to third-party websites; we are not responsible for their content or practices.

Section 10 – Relationship with Shopify

Nexkart is powered by Shopify. All sales and purchases are made directly with Nexkart. Shopify is not a party to any transaction between you and Nexkart and is not responsible for any aspect of such transactions. You hereby release Shopify and its affiliates from all claims arising from your purchases with Nexkart.

Section 11 – Prohibited Uses

You may use our Services for lawful purposes only. You may not use the Services to: violate any applicable Indian laws or regulations; infringe intellectual property rights; harass or harm any person; transmit false or misleading information; send spam; impersonate any person; upload malicious code; scrape or automate access without authorisation; or engage in commercial resale of our products. We reserve the right to suspend or terminate your account for violations.

Section 12 – Disclaimer of Warranties

THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE SERVICE.

Section 13 – Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY INDIAN LAW, NEXKART SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH US. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC ORDER IN DISPUTE.

Section 14 – Indemnification

You agree to indemnify and hold harmless Nexkart, Shopify, CJ Dropshipping, Razorpay, and our respective affiliates, officers, employees, and agents from any claims, losses, or liabilities arising from: (1) your breach of these Terms; (2) your violation of any applicable law; or (3) your use of the Services.

Section 15 – Governing Law & Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts in India. Section 16 – Severability & Entire Agreement

If any provision of these Terms is found to be unlawful or unenforceable, it shall be severed without affecting the remaining provisions. These Terms, together with our Privacy Policy, Shipping Policy, and Refund & Returns Policy, constitute the entire agreement between you and Nexkart.

Section 17 – Changes to Terms

We reserve the right to update these Terms at any time. Material changes will be notified by posting the updated Terms on this page with a revised effective date. Continued use of our Services after changes are posted constitutes your acceptance.
